Slips, trips and falls – who’s to blame and can you make a claim?

Slips, trips and falls can be surprisingly dangerous. They make up for some of the most common workplace accidents and run the risk of causing some serious injury and disruption to your life. But who is actually to blame for your accident, and can you make a claim?

    Finding out who is responsible

When you’ve had a slip, trip, or fall, it’s easy to put the blame on yourself. It’s true that sometimes we do just take a tumble, and it’s down to nobody but us. But the reality is that in many cases, your fall could be directly attributed to someone else’s negligence.

The fallout from a tumble can be considerable. You don’t have to fall very far or very hard at all to risk seriously injuring yourself. There’s not only the psychological and physical pain to consider, either. If you’re unable to work as effectively, or at all in some cases, you and your family could be at risk of unnecessary financial hardship. This is why it’s so essential to make a claim when you can.

They should have insurance cover- use it

Most employers and owners of public spaces will have some form of employee safety insurance or public liability insurance, respectively. These packages exist specifically to provide cover in the event someone gets injured in an accident that wasn’t their fault. There should also be coverage in place in the event of an accident caused by the actions of a company’s employee.

What does that mean for you? It means you shouldn’t just “take it on the chin” if your accident was caused by someone else. The exact way your claim will be handled depends on the nature of your accident. It’s essential to get your claim started as soon as possible if you’re going to make one. That way, you can gather any supporting evidence and eyewitness testimony while it’s still fresh.

    What can your compensation cover?

Your compensation payment can go to a range of things, depending on the nature of your claim. It could be damaging for the pain and suffering you experienced, it could go to medical and physiotherapy costs if you required treatment, or it could be used to help cover your lost earnings while you were unable to work due to your injury.

    The importance of professional representation

If you’ve had a slip, trip, or fall that wasn’t your fault, you should seek the services of a professional and experienced personal injury claims solicitor. They will be able to examine your case, the nature and circumstances of the accident, and help guide you through the claims process. They’ll be able to give you the best possible idea of what sort of evidence you’ll need to support your claim and be able to demystify each step of the journey. Ultimately, this should give you more peace of mind and minimise the stress involved with claiming.

If you’ve been injured as a result of a slip, trip, or fall that wasn’t your fault, make your claim for compensation today.
